Richard Ernest Santora
Mr. Santora is a partner, and since 2004, the Chief Operating Officer of Milling Benson Woodward L.L.P. Richard Santora is engaged primarily in the Corporate and Health Law practice areas.
Mr. Santora is a member of the American Bar Association, the Federal Bar Association, the Louisiana State Bar Association, the Mississippi State Bar Association, the American Health Lawyers Association, the Louisiana Society of Hospital Attorneys, Louisiana Defense Counsel Association, and other groups.
Mr. Santora is admitted to practice before the United States District Courts in the Eastern and Middle Districts of Louisiana, the United States Court of Appeal for the Fifth Circuit, the United States Supreme Court, and the State Courts of Louisiana and Mississippi.
Mr. Santora has represented health care providers, including hospitals, physicians, physician practice groups, home health agencies, and independent diagnostic testing facilities, in the negotiation and preparation of physician recruitment agreements, medical director agreements, nurse staffing agreements, physician employment agreements, practice side Low-Income and Needy Care Collaborative agreements, physician hospital organizations, clinical integration and related agreements. He has represented health care providers and provided advice on compliance with The Health Insurance Portability and Accountability Act, limitations on physician self-referrals under the “Stark laws,” and the anti-kickback provisions of the Fraud and Abuse laws.
Mr. Santora has created various types of entities, including corporations, limited liability companies, professional medical corporations, and partnerships. Mr. Santora has also represented developers and owners in land acquisition, financing, negotiation, and preparation of architect’s and contractor’s contracts for multi-million dollar office buildings, and has represented automobile dealerships and heavy equipment dealers in the acquisition, sale, and merger of dealerships. He has experience negotiating and drafting cooperative endeavor agreements, special services agreements, value added reseller agreements, licensing agreements, master services agreements, and related business contracts.
Mr. Santora was appointed to the adjunct faculty of the University of New Orleans beginning in 2013, and teaches a course titled “Health Care Law and Ethics” within the College of Business Administration, Master of Science in Health Care Management.
Mr. Santora’s litigation experience includes representing relators (plaintiffs) in Federal False Claims Action “Qui Tam” litigation, based upon Medicare false billing; and runs to defense of a premises owner from a claim that an employee contracted MAC (Mycobacterium avium-intracellulare) during the renovation of the property, and to representation of plaintiffs in review of an action for breach of fiduciary duty owed by a corporate officer and director. Richard Santora also has represented LIGA (the Louisiana Insurance Guaranty Association) and Gray Insurance Co. in general casualty defense litigation.
